Privacy Policy.

This Privacy Policy describes how Scentd LLC ("Scentd," "we," "us," or "our") collects, uses, shares, and protects information when you use scentd.studio, our mobile applications, and any related services (collectively, the "Service"). This Privacy Policy applies to all visitors, users, buyers, sellers, and community members of the Service.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our policies and practices, do not use the Service. This Privacy Policy is incorporated by reference into the Scentd Terms of Service.

We have written this Privacy Policy in plain English wherever possible. If you have questions about anything here, contact us at privacy@scentd.com.

§ 1Information We Collect

We collect several types of information depending on how you use the Service.

1.1 Information You Provide Directly

When you create an account, list a fragrance, make a purchase, post in the community, or otherwise interact with the Service, you may provide us with:

  • Account information: your name, email address, password (stored only as a hashed value), username, profile photo, and biographical information you choose to share.
  • Identity verification information: phone number (required to list items above $50), and for sellers, payment account details verified through Stripe Connect. We do not store full bank account or card numbers — these are held by Stripe.
  • Shipping and billing information: physical addresses for sending and receiving items, payment method details (tokenized and stored by Stripe, not by us).
  • Listing information: descriptions, photos, batch codes, sourcing details, prices, and any other information you provide when listing a fragrance for sale.
  • Community content: posts, reviews, ratings, comments, Sniff Test verdicts, questions, and any other content you submit to the community feed.
  • Transaction information: details of items you buy and sell, including timing, amounts, dispute history, and communications with the other party.
  • Communications with us: emails, support tickets, takedown requests, and other correspondence.

1.2 Information Collected Automatically

When you use the Service, we automatically collect certain information about your device and how you interact with the Service:

  • Device information: device type, operating system, browser type and version, IP address, device identifiers, and screen resolution.
  • Usage information: pages viewed, listings searched, time spent on the Service, click patterns, referring URLs, and timestamps of activity.
  • Location information: approximate location derived from your IP address. We do not collect precise GPS location unless you explicitly opt in to a feature that requires it.
  • Cookies and similar technologies: see Section 8 below for details on our cookie practices.

1.3 Information From Third Parties

  • Payment processors: Stripe provides us with verification status, payout history, and dispute information necessary to operate the marketplace.
  • Identity verification services: when you verify your phone number or identity, we may receive confirmation status from the verification provider.
  • OAuth providers: if you sign in using Google, Apple, or another OAuth provider, we receive basic profile information from that provider.
  • Brand protection partners: trademark holders may notify us of allegedly infringing listings on the Service.

§ 2Fragrance Product Data and Photographs

Because Scentd is a fragrance marketplace, we collect and use a specific category of information called "Fragrance Product Data," as defined in Section 5.4 of our Terms of Service.

2.1 What Fragrance Product Data Includes

Fragrance Product Data is information about the products you list, buy, or discuss on the Service, including:

  • Fragrance names, brands, and product identifiers
  • Batch codes and production date information
  • Photographs of bottles, packaging, atomizers, and labels
  • Sourcing details (where you obtained the bottle)
  • Product metadata you provide or that we derive from listing information

2.2 How We Use Fragrance Product Data

Fragrance Product Data is essential to making Scentd more trustworthy. We use it to:

  • Operate the marketplace and display listings to buyers
  • Build a private reference database of authentic fragrance bottles, batch codes, and packaging that allows us to detect potential counterfeits
  • Train and improve computer vision, machine learning, and artificial intelligence systems that may, over time, help identify counterfeit fragrances
  • Cross-reference new listings against historical listings to identify inconsistencies
  • Power community-based authentication features like The Sniff Test
  • Develop aggregated and anonymized data products that improve trust and safety on the Service

2.3 What This Means For You

When you list a fragrance, the photographs and product information you submit may be retained by Scentd indefinitely, even after the listing is removed, sold, or expired, and even after you close or delete your account. This retention is necessary to build and maintain our authenticity reference database over time.

We do not retain personally identifying information beyond what is permitted by this Privacy Policy and applicable law. Photographs and product data are retained primarily in aggregated, anonymized, or de-identified form for authentication purposes. We do not, for example, keep your name attached to bottle photographs in the long-term reference database.

If you list a fragrance on Scentd, you are agreeing to this use of your photographs and product data. If you do not want your photographs to be used in this way, do not list items on Scentd.

§ 3How We Use Your Information

3.1 Provide and Operate the Service

  • Create and maintain your account
  • Process transactions through Stripe Connect, hold funds in escrow, and disburse payments
  • Display listings and community content to other users
  • Facilitate communications between buyers and sellers
  • Resolve disputes, process refunds, and handle takedown requests
  • Send service-related communications (purchase confirmations, shipping updates, dispute notices)

3.2 Trust and Safety

  • Detect and prevent fraud, counterfeit listings, and other prohibited activity
  • Verify identity and enforce seller level limits and price caps
  • Investigate complaints, takedown requests, and reports of policy violations
  • Suspend or terminate accounts that violate our Terms of Service
  • Maintain a public transaction history so buyers can evaluate seller reputation
  • Cooperate with law enforcement, brand protection partners, and authorized third parties investigating fraud

3.3 Improve and Personalize the Service

  • Understand how users interact with the Service so we can improve it
  • Recommend listings, fragrances, and content that may interest you
  • Develop new features based on aggregated usage patterns
  • Conduct research and analysis to improve trust and safety systems

3.4 Marketing Communications

With your consent (or where permitted by applicable law), we may send you marketing emails about new features, fragrances we think you'd like, founding seller programs, or other Scentd updates. You can opt out at any time by clicking the unsubscribe link in any marketing email or by adjusting your notification preferences in your account settings. Opting out of marketing emails does not stop transactional emails.

3.5 Legal and Compliance

  • Comply with legal obligations, including tax reporting and law enforcement requests
  • Respond to subpoenas, court orders, and legal process
  • Enforce our Terms of Service and other agreements
  • Protect the rights, property, and safety of Scentd, our users, and the public

§ 4How We Share Your Information

We do not sell your personal information. We share information only in the limited circumstances described below.

4.1 With Other Users

Scentd is a marketplace and community, so some information you provide is visible to other users by design, including your username, profile photo, listings, posts, seller reputation statistics, and your shipping address (to the other party in a transaction only, for fulfillment purposes).

4.2 With Service Providers

We share information with third-party service providers contractually required to protect your information and use it only for the services they provide to us, including: Supabase (database and auth), Stripe (payments), Vercel (hosting), Resend (email), CheckFresh (batch code verification), and analytics providers.

4.3 With Brand Protection Partners

If a trademark holder submits a credible takedown notice, we may share information about the listing and the seller as necessary to investigate the claim.

4.4 For Legal Reasons

We may share your information when necessary to comply with applicable law, investigate illegal activities, protect the rights and safety of Scentd or our users, or enforce our agreements.

4.5 In Business Transfers

If Scentd is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred. We will notify you of any change in ownership or use of your personal information.

4.6 Aggregated and De-Identified Information

We may share aggregated, anonymized, or de-identified information that does not directly identify you with third parties for research, analysis, marketing, or other purposes.

§ 5Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information, including encryption of data in transit (TLS), encryption of sensitive data at rest, Row Level Security (RLS) policies at the database level, access controls, regular security reviews, and tokenization of payment information via Stripe.

No security system is impenetrable, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and applicable regulators as required by law.

§ 6How Long We Keep Your Information

  • Account information: retained while your account is active; deleted or anonymized within 30 days of account deletion, except as described below.
  • Transaction records: retained for at least seven (7) years to comply with tax, financial, and dispute-resolution obligations.
  • Communications and dispute records: retained as long as necessary to resolve open disputes and for a reasonable period afterward.
  • Public content: posts and comments may remain visible after account closure, though we will remove your username from them upon request.
  • Fragrance Product Data and photographs: may be retained indefinitely in aggregated, anonymized, or de-identified form for authenticity reference purposes, even after account deletion.
  • Legal and compliance records: retained as long as necessary to comply with legal obligations and defend legal claims.

§ 7Your Privacy Rights

7.1 Rights You Always Have

  • Access: you can request a copy of the personal information we hold about you.
  • Correction: you can update or correct inaccurate information through your account settings or by contacting us.
  • Deletion: you can request that we delete your account and associated personal information, subject to the exceptions described in Section 6.
  • Data portability: you can request an export of your information in a machine-readable format.
  • Opt-out of marketing: you can opt out of marketing communications at any time.

7.2 California Residents (CCPA / CPRA)

If you are a California resident, you have additional rights under the CCPA and CPRA, including the right to know what personal information we collect, the right to delete, the right to correct, the right to opt out of sale or sharing, the right to limit use of sensitive personal information, and the right to non-discrimination for exercising your rights. 7.3 Other State Privacy Laws

If you are a resident of Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive privacy law, you have similar rights. Contact us at privacy@scentd.com.

7.4 How to Exercise Your Rights

Email us at privacy@scentd.com or use the privacy controls in your account settings. We will respond within the timeframes required by applicable law (typically 30 to 45 days).

§ 8Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Service, remember your preferences, analyze usage patterns, and improve your experience.

  • Essential cookies: required for the Service to function, including authentication and security. You cannot opt out of these cookies.
  • Functional cookies: remember your preferences (such as language, region, and display settings).
  • Analytics cookies: help us understand how users interact with the Service using privacy-respecting tools that do not track you across other websites.

You can control cookies through your browser settings. We honor Global Privacy Control (GPC) signals where applicable.

§ 9Children's Privacy

The Service is not directed to children under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we discover we have collected information from a person under 18, we will delete it promptly. Contact privacy@scentd.com if you believe a child has provided us with personal information.

§ 10International Users

Scentd is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer. We currently focus on users located in the United States.

§ 11Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date, notify you by email or through a prominent notice on the Service, and for significant changes, give you the opportunity to review the new policy before it takes effect.

§ 12Do Not Track and Global Privacy Control

We honor GPC signals as a valid opt-out request for the sale or sharing of personal information under applicable state privacy laws. We do not currently respond to general Do Not Track browser signals because there is no industry standard for how to interpret them.

§ 13Third-Party Links and Services

The Service may contain links to third-party websites, services, or applications. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing them with any information.
